WHAT TO DO IF YOU GET A PHOTO RADAR TICKET
Arizona is out of money and is rushing to embrace photo radar as an automated source of easy money. Don't be deceived that photo radar, just like Arizona's fanatic DUI laws, have anything to do with public safety; they're all about MAKING MONEY!
Excluding cases of criminal speed, photo radar tickets for speeding and running red lights are civil, not criminal. The Rules of Civil Procedure apply. The citation must be served on you by a process server just like a civil lawsuit. When you are stopped by an officer and sign a citation promising to appear in court you are waiving your service of process. But, when you receive a photo radar citation in the mail that is NOT service of process. the are simply hoping that you sign and return it or appear in court thereby waiving service of process and submitting to their jurisdiction.
1. So the first thing to do when you receive a photo radar ticket by mail is disregard
it. Throw it away!
2. Wait for SERVICE. Government agencies don't all have process servers
available. Those that do are swamped and can't possibly serve everyone who is
mailed a citation. If you ignore your mailed citation you may well fall between the
cracks. If the government does hire a process server to serve you he may or may
not be successful.
3. If you are served contact the Law Offices of Joe Saienni.
Identification, the citations computerized signature, traffic conditions, etc. are all
challenges that can get you out of the points, fines and traffic school these
violations carry. Do not be victimized by the government simply because they
need more of your money!
